These Terms govern your use of Skycaster, a professional weather forecasting platform licensed exclusively for television broadcast and commercial media use.

By accessing or using Skycaster ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are accessing the Service on behalf of a television station, broadcaster, media company, or other organization ("Organization"), you represent and warrant that you have authority to bind that Organization to these Terms. If you do not agree to these Terms, you must not use the Service.
Skycaster is licensed exclusively for internal broadcast and commercial weather forecasting purposes. Authorized uses include: • On-air weather forecasting and visualization for licensed television broadcasts. • Internal production workflows, including pre-production weather analysis. • Display of weather data and maps within your own broadcast programming. • Creation of weather graphics, segments, and forecast packages for your own broadcast channels. All other uses require express written consent from Skycaster.
You may not, under any circumstances: a) Redistribution — Resell, sublicense, redistribute, or make the Service, its data, outputs, or any derivative works available to third parties, whether for free or for compensation. b) API Layer Creation — Build, operate, or expose any API, web service, data feed, or programmatic interface that proxies, wraps, mirrors, or otherwise re-serves Skycaster data or functionality to third parties. Creating an API layer over Skycaster for external consumption is strictly prohibited. c) Competitive Products — Use the Service or its underlying data to develop, train, or improve any product or service that competes with Skycaster. d) Automated Scraping — Use bots, crawlers, scrapers, or automated scripts to extract data from the Service beyond what is permitted by your API key's rate limits and documented endpoints. e) Unauthorized Sharing — Share your account credentials or API keys with individuals or entities outside your Organization. f) Misrepresentation — Represent Skycaster data as your own proprietary data source, or remove, obscure, or alter any attribution required by Skycaster or its upstream data providers.
Access to Skycaster's programmatic endpoints is granted via API keys issued to your Organization. API keys: • Are tied to a single Organization and may not be transferred or shared externally. • Are subject to rate limits defined in your subscription plan. • Must not be embedded in publicly accessible client-side code or distributed software. • May be revoked immediately if misuse is detected. Exceeding rate limits or violating key usage policies may result in throttling, suspension, or termination of access.
Access to the Service is provided on a subscription basis. By subscribing you agree to pay all fees associated with your chosen plan. Fees are billed in advance on the applicable billing cycle (monthly or annual). All payments are processed securely through Stripe. Failure to maintain a current, valid payment method may result in suspension of the Service. Skycaster reserves the right to modify pricing with at least 30 days' prior notice to active subscribers.
All content, software, algorithms, visual designs, data models, and technology comprising the Service are the exclusive intellectual property of Skycaster and its licensors. These Terms do not grant you any ownership rights in the Service. You retain ownership of your own broadcast content, but grant Skycaster a limited license to process your configuration data solely to provide the Service. Weather data sourced from third-party providers (including Open-Meteo) remains subject to their respective licenses. You agree to comply with any attribution requirements imposed by such providers.
Skycaster collects and processes account information and usage data necessary to provide the Service. We do not sell your data to third parties. You are responsible for maintaining the confidentiality of your credentials and for all activity occurring under your account. You agree to notify Skycaster promptly at support@skycaster.tv if you suspect unauthorized access.
Skycaster strives to maintain high availability but does not guarantee uninterrupted or error-free operation. Scheduled maintenance windows will be communicated in advance where possible. Skycaster shall not be liable for outages caused by third-party data providers, infrastructure failures, or circumstances beyond our reasonable control (force majeure).
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF WEATHER DATA. WEATHER FORECASTS ARE PROBABILISTIC IN NATURE. SKYCASTER DOES NOT WARRANT THAT FORECASTS WILL BE ACCURATE OR SUITABLE FOR SAFETY-CRITICAL DECISIONS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SKYCASTER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, LOSS OF BROADCAST TIME, OR REPUTATIONAL HARM, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. SKYCASTER'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO SKYCASTER IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
Either party may terminate these Terms at any time. Skycaster may suspend or terminate your access immediately, without notice, for material breach of these Terms, including but not limited to redistribution or unauthorized API layer creation. Upon termination, all rights granted to you cease immediately. Sections 3, 6, 9, 10, and 12 survive termination.
These Terms are governed by the laws of the jurisdiction in which Skycaster is incorporated, without regard to conflict of law principles. Any dispute arising from these Terms shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be resolved by binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction for violations of intellectual property rights or the prohibitions in Section 3.
Skycaster reserves the right to update these Terms at any time. We will notify active subscribers via email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
